Can I rely on an Architect’s or Professional Consultant’s Certificate?

Can you rely on an Architect’s or Professional Consultant’s Certificate? A fairly recent court case highlighted some of the issues associated with relying on an Architects or Professional Consultants Certificate. Unfortunately, these types of certificates are just an extension of the consultant’s professional indemnity cover. As such, you will need to be able to prove the Architect or consultant was professionally negligent in not spotting the issue that lead to the defect arising. That can be a time-consuming and expensive exercise. If the Architect or professional is no longer in practice or fails to renew their cover it can often lead to no protection whatsoever.

Lenders are generally becoming more fussy over acceptance for Lending purposes and we find that people are more frequently having to arrange a Structural Warranty retrospectively because they are struggling to sell a property that was built with the benefit of an Architects Certificate.
